6. Consumer Protection Act
Where the Consumer Protection Act 68 of 2008 ("CPA") applies, nothing in these Terms limits any rights the client may have under the CPA. If the client is a juristic person (company/CC) with an asset value or annual turnover exceeding R2 million, the CPA does not apply to this agreement.
7. Project Payments
When you engage NetCore 145 for services, the payment structure will be confirmed in your quote or agreement. Unless otherwise agreed:
- A deposit may be required before work begins.
- The remaining balance is due before final launch, handover, or delivery.
- Work may pause if required payments are not received on time.
- Payments/deposits under R500 are non-refundable.
- Transfers of final website files or deliverables will only be done after the full payment has been received.
8. Minimum Term
Monthly website and hosting packages are subject to a minimum term of 12 months. If a client cancels before the end of the minimum term, the remaining monthly fees for the balance of the term become immediately payable.
9. Cancellation and Refunds
Once work has commenced, cancellation by the client does not entitle them to a refund of any deposit paid. If a project is cancelled mid-way, the client is liable for payment for all work completed up to the date of cancellation.
10. Client Responsibilities
You are responsible for providing accurate business information, content, images, login details, approvals, and feedback needed to complete the project. Delays in providing required material may affect delivery timelines.
11. Revisions and Changes
Projects may include a reasonable number of revisions as agreed in your quote. Extra features, additional pages, major redesigns, or new requests outside the original scope may require an additional fee.
12. Hosting, Domains, and Third-Party Services
Some services may rely on third-party providers such as domain registrars, hosting companies, Google, email platforms, plugins, payment gateways, or analytics tools. NetCore 145 (Pty) Ltd is not responsible for outages, policy changes, price changes, or technical issues caused by third-party providers.
13. Domain & Hosting Renewal
Domain and hosting services are renewed annually. It is the client's responsibility to ensure renewal fees are paid on time. NetCore 145 (Pty) Ltd is not liable for loss of domain, website downtime, or data loss resulting from non-payment of renewal fees.
14. Email Deliverability Disclaimer
While we take reasonable steps to ensure email deliverability, NetCore 145 (Pty) Ltd does not guarantee that emails sent from client accounts will always reach the recipient's inbox. Deliverability depends on third-party email providers' spam filters and the reputation of shared server IP addresses, which are outside our control.
15. Limitation of Liability
NetCore 145 (Pty) Ltd will not be liable for indirect, incidental, special, or consequential damages arising from your use of this website or our services. We aim to provide reliable services, but we do not guarantee that the website or third-party services will always be uninterrupted or error-free.
16. Accuracy of Information
We aim to keep website information accurate and up to date, but we may update services, pricing, packages, features, or content at any time without prior notice.
17. Force Majeure
Neither party shall be liable for any failure to perform its obligations under these Terms if such failure is caused by events beyond reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, government regulations, cyber-attacks, or infrastructure failures.
18. Governing Law
These terms are governed by the laws of South Africa.
19. Dispute Resolution
If a dispute arises from your use of our website or services, we agree to first attempt to resolve it informally through:

If we cannot resolve the dispute within 14 days, either party may refer the matter to mediation or arbitration in accordance with South African law.

In terms of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), NetCore 145 (Pty) Ltd maintains a PAIA Manual which sets out the records we hold and how members of the public can request access to those records.
34. How to Request Access to Records
To request access to records held by NetCore 145 (Pty) Ltd, you must:
- Complete Form C, as prescribed by the Information Regulator.
- Submit the completed form to support@netcore145.co.za.
- Pay the prescribed request fee, if applicable.
We will respond to your request within 30 days as required by PAIA, unless an extension is lawfully required.
35. Request Fees
The following fees may apply to requests for access to records, in line with PAIA regulations:
- Request fee: R50 (payable before the request is processed).
- Access fee: Dependent on the form of access and the volume of records requested.
- Copying fees: As prescribed by PAIA regulations.
Fees may be waived in certain circumstances as provided for in PAIA.
